Terms of Service

• "Edufied", "we", "us", "our" means Joshua Rentenaar trading as Edufied (ABN: 91 731 785 958).
• "Platform" means edufied.com.au and all associated teacher and student applications operated by Edufied.
• "Teacher" means any individual who creates an account to use the Platform in a professional educational capacity.
• "Student" means any individual whose account is created and managed by a Teacher.
• "School" means the educational institution on whose behalf a Teacher uses the Platform.
• "Content" means any data, text, lesson materials, assignments, class names, or other material submitted to the Platform by a Teacher.
• "Subscription" means a paid plan that unlocks additional Platform features.

By creating an account or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

If you are using the Platform on behalf of a School, you represent that you have authority to bind the School to these Terms.

• Teachers must be at least 18 years old and authorised by their School to use the Platform on the School's behalf.
• Students may only access the Platform through accounts created by their Teacher. Students do not independently agree to these Terms: their use is governed by their School's relationship with Edufied.
• Edufied is intended for use in secondary and primary school settings. It is not directed at children who are accessing the Platform independently outside of a school context.

Teachers are responsible for:

• Keeping their login credentials confidential and secure.
• All activity that occurs under their account.
• Creating student accounts only for students enrolled in their class at their School.
• Ensuring that student PINs are kept confidential and not shared beyond the intended student.
• Notifying us immediately at support@edufied.com.au if they suspect unauthorised access to their account.

Teachers must not:

• Share their login credentials with other people, including other teachers.
• Create student accounts for individuals who are not their students.
• Allow students to access teacher account features.

Your use of the Platform is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination of your account.

Some features of the Platform require a paid Subscription:

• Subscription fees are charged in Australian dollars (AUD) unless otherwise stated.
• Payments are processed by Stripe, Inc. We do not store your card number.
• Your Subscription renews automatically at the end of each billing period unless you cancel before renewal.
• You may cancel at any time from Account Settings. Cancellation takes effect at the end of the current billing period.
• Pricing may change with reasonable prior notice by email before any price change affects your existing Subscription.

Refunds: We offer refunds in accordance with our obligations under the Competition and Consumer Act 2010 (Schedule 2: Australian Consumer Law). If you experience a technical issue or a failure of the Platform to deliver its core functionality, contact billing@edufied.com.au. Refunds are not provided for change-of-mind cancellations after a billing period has begun, except where required by law.

Your Content: You retain all ownership rights in the Content you submit to the Platform. By submitting Content, you grant Edufied a non-exclusive, royalty-free licence to store, display, and process your Content solely for the purpose of providing the Platform to you.

Our Platform: All intellectual property in the Platform (including its design, code, branding, and features) belongs to Edufied. These Terms do not grant you any right to use Edufied's trademarks, logos, or proprietary materials.

By you: You may delete your account at any time from Account Settings. On deletion, your personal data and your students' data will be removed in accordance with our Privacy Policy.

By us: We may suspend or terminate your account if you breach these Terms or our Acceptable Use Policy. Where practical, we will give notice and an opportunity to remedy a breach before terminating. We reserve the right to terminate immediately for serious violations.

Effect of termination: On termination, your right to access the Platform ends. We will retain data only as required by law and delete it on schedule as described in our Privacy Policy.

To the fullest extent permitted by law:

• The Platform is provided "as is". We do not warrant that it will be uninterrupted, error-free, or meet your specific requirements.
• Our total liability to you for any claim will not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not liable for any indirect, consequential, special, or incidental loss or damage, including loss of data or loss of revenue.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term implied or imposed by the Competition and Consumer Act 2010 (Schedule 2: Australian Consumer Law) that cannot lawfully be excluded or limited. Where the ACL applies, our liability is limited to resupplying the relevant service or paying the cost of having the service resupplied, at our election.

These Terms are subject to Australian law and do not affect your statutory consumer rights.

These Terms are governed by the laws of Western Australia, Australia. Any dispute arising in connection with these Terms or the Platform will be subject to the exclusive jurisdiction of the courts of Western Australia.

We encourage you to contact us at support@edufied.com.au before initiating any legal proceedings. Most issues can be resolved quickly and informally.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
